Divorce Sales When One Spouse Has Moved Out of State

The spouse who moved away still joins the sale: signing before a notary where they live, two sets of instructions, and one report both spouses read.

Remodeled kitchen in an Anaheim Hills house with white shaker cabinets and brass pulls, a stainless range hood over a gas cooktop, a wall oven, marble-look counters and a farmhouse sink below a window.

A California house can be sold during a divorce when one spouse has already moved to another state, but that spouse still has to join the sale, either by signing in person before a notary where they now live or through an agent the title company accepts. The sale then runs on two sets of instructions: the spouse in California handles access and the walkthrough, the spouse out of state reviews the same report remotely, and each signs their own escrow papers, tax forms and payout instructions. How the net is held, and whether the move changes anything in the case, are questions for the family-law attorneys.

This article covers the case where one spouse is gone and the other is still near the house. If both of you have left, the access and contents questions change, and our guide to selling a Southern California house from out of state covers that wider case.

Moving away does not take a spouse off the sale

Family Code section 1102 says both spouses, personally or through a duly authorized agent, must join in any instrument that sells, conveys or encumbers community real property. Living in another state does not change that. Escrow and the title company will ask for both signatures, or for a court order that authorizes the sale.

The move also does not suspend the case. In a California divorce, Family Code section 2040 puts a temporary restraining order on the summons that restrains both parties from transferring, encumbering, concealing or in any way disposing of property without the other's written consent or a court order, except in the usual course of business or for the necessities of life. That order binds the spouse who left as much as the one who stayed. So the attorneys usually document consent, or obtain an order, before anyone signs, and the closing waits for it.

Where a case is filed is its own question. The California Courts self-help guide says that to file for divorce in California, one spouse must have lived in the state for the last six months and in the county for the last three. If the spouse who moved has filed, or plans to file, somewhere else, how that case touches a California house is for attorneys to sort out before the sale is planned around it.

How the out-of-state spouse signs

There are two usual routes, and the title company should confirm which it accepts before escrow opens:

  • A notary where they live. Civil Code section 1189(b) says a certificate of acknowledgment taken in another place is sufficient in California if it is taken in accordance with the laws of the place where the acknowledgment is made. Escrow sends the signing package, and the spouse signs before a notary in their own state. Our comparison of remote online notarization vs. a mobile notary explains what works today and what does not.
  • An authorized agent. Section 1102 allows a duly authorized agent to sign. In a divorce, a power of attorney raises questions of its own, especially if the agent would be the other spouse. Ask both attorneys before anyone relies on one, and ask the title company whether it will insure a sale signed that way.

Two sets of instructions, one sale

The sale needs the same things from both spouses, delivered from two places. Writing down who does what prevents the most common delay: each spouse assuming the other handled it.

The walkthrough is the step the absent spouse most often worries about, because the other spouse was there and they were not. The fix is simple: both receive the same record. Our article on walkthrough photos and video lists what you should receive, and keys, lockboxes and access from another state covers the rest.

Tax paperwork in two states

California has its own real estate withholding, certified by the sellers before close. Divorcing spouses should ask escrow and a tax professional whether they complete one form or two. A spouse who now lives elsewhere may also have questions in their new state. Our guide to California withholding (Form 593) lists what to ask escrow; how the move affects either spouse's taxes is for a tax professional, and each spouse may want their own.

The net, across state lines

Escrow pays off the loan and any liens. What happens to the remainder, whether it is split at closing or held until the division is decided, is for the parties to agree or the court to order, and the attorneys give escrow those instructions. Family Code section 2550 says that, unless the parties agree in writing or orally in open court, the court divides the community estate equally; that is context only, and a move does not change who decides.

When money will be wired to an account in another state, confirm the wiring instructions by phone with escrow, at a number taken from a source you already trust, before anything is sent. Two households receiving emails about one sale is exactly the setting wire fraud at closing depends on.

One page both spouses read from two places

The written report carries two numbers on the same house: an as-is cash offer and an open-market read, each with comparable sales, line-item deductions and the net before division. The open-market read is a preliminary estimate, not an appraisal. It is not an automated estimate, and if the case needs a certified appraisal, that comes from a state-licensed or certified appraiser; Mr. Cali Offers does not do appraisals. Both spouses, or both attorneys, receive the report at the same moment, so the spouse who was not at the walkthrough is not reading a summary from the one who was. Our article on what family-law attorneys need from a buyer lists the rest of the paper.

If the spouse near the house will stay until a set date, see move-out dates written into the offer.

When listing nets more

A cash offer is generally below what the open market would bring, because the buyer takes on repairs, holding costs, resale costs and risk, and buys for profit. A listing can work with one spouse away, especially when the spouse near the house will keep it ready for showings. Listing usually nets more when the house is in good condition and would draw financed owner-occupant buyers, when both spouses can agree on price and on each offer from two places, and when the settlement leaves time for a full marketing period. When the open-market read nets more, the written recommendation says so, and both parties are introduced to a designated local expert, an independently licensed California agent who works that neighborhood. Mr. Cali Offers never lists a house.

What this looks like in practice

These are the kinds of files that come in, described without names or figures.

  • A Glendora foothill house where the spouse who moved away still shares the insurance bill. Wildfire exposure and insurance cost weigh on foothill sales there, and both spouses want to see that reflected on the same page.
  • A Rancho Cucamonga house in Etiwanda, inside a community facilities district. When the tax bills are mailed to the house, the spouse out of state may never have seen the special tax line; the report shows it and any arrears before division. See property tax bills for absentee owners.
  • A file where the spouse who left wants the sale but cannot travel to sign. The package goes to a notary in their state once both attorneys have documented consent.

Next step

For the whole divorce sale, read selling a house during divorce in California and selling before or after the divorce is final. The remote steps are in the remote sale workflow, start to finish. More is collected in the divorce sales section. When both owners agree to receive the numbers, see how we handle a house sale during a divorce or call (909) 498-3977. There is no cost and no obligation to get the two numbers and the written report.

Mr. Cali Offers is not a law firm, a tax adviser or an escrow company. Cash offers come from independent buyers and investors who buy for their own account and may resell for profit; a cash offer is generally below what the open market would bring. Any value shown is a preliminary estimate, not an appraisal. Nothing here is legal, tax or financial advice.

Frequently asked questions

Can we sell the house if my spouse has moved to another state?

Yes, but the spouse who moved still has to join the sale. California Family Code section 1102 requires both spouses, personally or through a duly authorized agent, to join in selling community real property, and the restraining orders on a California divorce summons still apply to both. Your family-law attorney can confirm what your case needs.

Does my spouse have to fly back to California to sign?

Usually not. California Civil Code section 1189(b) treats a certificate of acknowledgment taken in another state, under that state's law, as sufficient in California, so escrow can send the package to a notary where your spouse lives. The title company should confirm what it accepts before escrow opens.

Can I sign for my spouse under a power of attorney?

Section 1102 allows a duly authorized agent to sign, but in a divorce a power of attorney between spouses raises questions of its own. Ask both attorneys before relying on one, and ask the title company whether it will insure a sale signed that way.

How does the spouse who moved away see the house's condition?

Both spouses, or both attorneys, receive the same walkthrough photos, video and written report at the same moment, so the spouse who was not there reads the same comps, line-item deductions and net before division as the one who was.
